This policy outlines how copyright holders can submit infringement notices and how users can respond to such notices.

Reporting Copyright Infringement (DMCA Takedown Notice)

If you believe that material on PolarisMobility.com infringes upon your copyright, you may send a written DMCA takedown notice to our Designated Agent. Your notice must include all of the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

  • Your contact information, including your full name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Process

If PolarisMobility.com removes your content due to a copyright infringement notice, and you believe your content was removed by mistake or misidentification, you may submit a counter-notification. This counter-notification must be in writing and contain the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled. Identify the location where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the United States, that you consent to jurisdiction of any judicial district in which PolarisMobility.com may be found).
  • A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receiving a valid counter-notification, we will forward a copy to the original complaining party. We will then generally reinstate the removed material in 10 to 14 business days, unless the copyright owner files an action seeking a court order to restrain the user from engaging in infringing activity related to the material.

Repeat Infringer Policy

PolarisMobility.com will terminate user accounts of those found to be repeat copyright infringers. We reserve the right to remove content and terminate accounts at our sole discretion for any reason, including violations of intellectual property rights. This measure helps maintain a respectful environment for content creators.
