Reporting Copyright Infringement (DMCA Takedown Notice)

Counter-Notification Process

If PolarisMobility.com removes your content due to a copyright infringement notice, and you believe your content was removed by mistake or misidentification, you may submit a counter-notification. This counter-notification must be in writing and contain the following:

Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled. Identify the location where the material appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
Your name, address, and telephone number.
A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside the United States, that you consent to jurisdiction of any judicial district in which PolarisMobility.com may be found).
A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receiving a valid counter-notification, we will forward a copy to the original complaining party. We will then generally reinstate the removed material in 10 to 14 business days, unless the copyright owner files an action seeking a court order to restrain the user from engaging in infringing activity related to the material.

Repeat Infringer Policy

PolarisMobility.com will terminate user accounts of those found to be repeat copyright infringers. We reserve the right to remove content and terminate accounts at our sole discretion for any reason, including violations of intellectual property rights.
